Who publishes this site, who sells the devices, and on what terms.

1. Site publisher

The site lumitherapie.eu is published and operated by:

AddressRue du Rhône 11, 1950 Sion, Switzerland
Emailinfo@lumitherapie.eu

2. Status of the products offered

The devices presented on this site are wellbeing products. They are not presented as medical devices and claim no purpose of diagnosis, prevention, monitoring, treatment or alleviation of any disease.

The information published in the "Understanding" and "Science" sections is intended as general information. It draws on publicly accessible scientific publications, cited with their reference, and constitutes neither medical advice nor a promise of results. It is in no way a substitute for a consultation. In the event of a symptom, illness, pregnancy, ongoing treatment or any doubt, please consult a healthcare professional.

3. Prices and taxes

Prices are provided on request, in euros, net of all taxes. The Centre de Thérapies Sion is not subject to Swiss VAT (art. 10 VAT Act) and therefore charges no VAT.

Shipments leave from Switzerland. For delivery within the European Union, the recipient is the importer: on receipt they pay the import VAT of their country as well as the carrier's customs clearance fees. These amounts are neither collected nor received by LumiThérapie. Trade in industrial products between Switzerland and the European Union is not subject to customs duties. Full details are given on the Delivery page.

4. Ordering and payment

As long as prices are not published on the site, sales are made by quotation: a request for a price does not constitute an order. The contract is formed when the customer accepts in writing the quotation sent to them.

The accepted means of payment are bank card, PayPal and bank transfer. Payment data is processed directly by the providers concerned: it does not pass through our servers and is never stored by us.

5. Delivery

The stated times run from dispatch and are given as an indication only. A delay in delivery cannot give rise to cancellation of the sale or to compensation, except where mandatory legal provisions applicable to consumers apply. Risk passes to the customer when the parcel is handed over by the carrier.

6. Right of withdrawal

Consumers residing in the European Union have fourteen days from receipt to withdraw, without having to give reasons for their decision. They inform LumiThérapie by email before the deadline expires. The device is returned complete, in a condition allowing resale; return costs are borne by the customer, except in the event of an error or defect attributable to the seller. Reimbursement takes place within fourteen days of receipt of the return.

This right does not apply to custom-made goods or to purchases made by a professional in the course of their business.

7. Warranty

The devices benefit from the two-year legal guarantee of conformity applicable to European Union consumers, without prejudice to the commercial warranties granted by manufacturers, whose duration and scope are set out in the quotation and the device documentation.

Excluded from the guarantee are: normal wear and tear, damage resulting from a fall, from non-compliant connection, from use contrary to the instructions, and any intervention or modification carried out by a third party.

8. Intellectual property

The structure of the site, its texts, its illustrations, its interactive diagrams and its visual identity are protected. Any reproduction, even partial, without prior written authorisation is prohibited. Manufacturers' trade marks and photographs are used with their agreement and remain their property.

9. Liability

LumiThérapie endeavours to ensure the accuracy of the information published, without being able to guarantee that it is free from error. The technical characteristics are those communicated by the manufacturers and may change without notice; only those appearing on the quotation are binding on the seller. LumiThérapie may not be held liable in the event of use of a device that does not comply with its instructions.

10. Applicable law and disputes

These conditions are subject to Swiss law. The place of jurisdiction is Sion (Valais, Switzerland). Mandatory provisions protecting the consumer in their country of residence within the European Union remain reserved: the consumer retains the option of bringing proceedings before the court of their domicile.

In accordance with the European regulation on online dispute resolution, consumers may also use the European Commission's dispute resolution platform.

11. Personal data

Data processing is described in our privacy policy, which complies with the GDPR and the Swiss Federal Act on Data Protection.
